Terms and Conditions Ocean Lovers Newsletter Competition

  1. Organizer

(1) The competition is organized by Schmuckkollektiv GmbH (hereinafter referred to as the "Organizer") (Impressum). The competition is not associated with Facebook and Instagram and is not organized, supported, or sponsored by Facebook and Instagram in any way. Facebook and Instagram are not available as contacts for the competition.

  1. Eligibility

(1) Eligible to participate are natural persons who are at least 18 years old at the time of participation and have their permanent residence in Germany.

(2) Employees of the organizer as well as their immediate family members (parents, siblings, children, and spouses) are excluded from participation.

(3) Participation in the competition does not require the purchase of products or services.

(1) To participate in the competition, participants must follow these steps:

(3) Enter their valid name and email address into the designated field in one of the email forms on the website (Pop-Up or Embed Form)

(4) Confirm your participation by clicking the Sign Up button

(5) Open the confirmation email in your inbox and click the button to complete the registration process.

(6) By registering, participants agree to receive the organizer's email newsletter. Unsubscribing from the newsletter is possible at any time and does not affect participation in the competition.

(7) Each participant can only participate in the competition once.

  1. Participation Period

(1) The competition ends on Saturday, July 5, 2025, at 12:00 PM.

  1. Winner Selection

(1) The winners of the competition will be randomly selected from all eligible entries.

(2) The winners will be notified by email within 2 days after the end of the participation period. It is the responsibility of the winners to ensure that the email address provided is correct and reachable.

(3) The winners must respond to the winning notification within 3 days of receipt and provide their contact details to accept the prize.

(4) If the winners cannot be contacted within this period or do not announce acceptance of the prize in due time, the organizer reserves the right to draw new winners.

  1. Prize

(1) The winners of the competition will each receive the entire Ocean Lovers Collection from LUAMAYA. The prize is not transferable and cannot be redeemed for cash.

  1. Data Protection

(1) The data collected during participation in the competition will be treated in accordance with applicable data protection regulations. By participating in the competition, participants agree to the organizer's privacy policy.

  1. Miscellaneous

(1) Legal recourse is excluded.

(2) The organizer reserves the right to change, suspend, or terminate the competition in case of unforeseen circumstances.

(3) These terms and conditions are subject to German law. By participating in the competition, you expressly agree to these detailed terms and conditions.

    Terms for Redeeming the Monthly Jewelry Subscription:

    • Advent calendars, vouchers, and already discounted items are excluded, as well as promotional goods explicitly excluded.
    • The €100 is not combinable with other discount promotions (RRP as the basis).
    • No cash payout available.
    • Monthly order required.
    • Up to €100 - The remaining balance can be carried over to the next month but cannot be cashed out. Any remaining balance after 12 months will expire.

    Subject of the Terms and Conditions and Organizer

    (1) These terms and conditions regulate the participation in the lottery and the necessary transfer of rights. The description and execution of the respective lottery will be carried out as part of the respective lottery campaign on Luamaya’s Facebook and Instagram pages.

    (2) The organizer of the competition is Luamaya.

    (3) By participating in the competition, the participant agrees to these terms and conditions.

    (4) The competition is not associated with Facebook or Instagram, and is neither sponsored, supported, nor organized by Facebook or Instagram.

    2. Participation

    (1) All individuals who are 18 years or older and have their residence in the DACH region (Germany, Austria, Switzerland) are eligible to participate. Participation with fake identities or third-party identities is not allowed.

    (2) Eligible participants can enter the competition by following the instructions provided in the post.

    (3) Participation is possible within the time frame published in the notification.

    3. Prizes and Prize Notification

    (1) We will raffle off prizes among all eligible participants.

    (2) Winners will be selected randomly within 2 weeks from all eligible participants. Winners will be notified via Instagram/Facebook comment function or in a separate post and asked to contact us via Direct Message or email, providing personal data that is truthful and correct. This information will be used to send the prize.

    (3) Winners must respond within 7 days after receiving the notification and provide their contact details to accept the prize.

    If winners cannot be contacted within this period or fail to notify their acceptance of the prize on time, the organizer reserves the right to draw new winners.

    (4) Only one prize per participant is allowed.

    (5) The prize is non-transferable and cannot be exchanged for cash.

    (6) If unforeseen circumstances arise that we are not responsible for, the respective winner agrees to an appropriate substitute prize.

    (7) Prizes will be sent to the winner’s provided address by post. Once the prize is handed over to a shipping company, the risk passes to the winner. We are not responsible for delivery damages.

    4. Liability and Indemnification

    (1) By uploading photos, the participant guarantees that they do not submit any content whose provision, publication, or use violates applicable laws or third-party rights.

    (2) The participant indemnifies us from all third-party claims of any kind arising from the illegality of photos used by the participant. The indemnification obligation also includes the obligation to fully indemnify the organizer from legal defense costs (e.g., court and attorney fees).

    (3) By participating in the competition, the participant releases Facebook from any liability.

    5. Exclusion

    (1) A violation of these terms and conditions entitles us to exclude the participant from participation. This applies especially if the participant provides false information or if used photos or other content (e.g., comments) violate applicable laws or third-party rights. The same applies to comments that could be considered violent, offensive, harassing, degrading, or otherwise contrary to decency.

    (2) If the excluded participant is a winner already drawn, the prize may be revoked.

    6. Early Termination and Changes

    We reserve the right to terminate the lottery at any time, even without notice, in whole or in part, or to modify it during the course of the lottery if, due to technical (e.g., computer viruses, manipulation, or errors in software/hardware) or legal reasons (e.g., Facebook prohibition), the proper execution of the lottery cannot be ensured.

    7. Data Protection

    We are responsible for the collection, processing, and use of participants' personal data, as far as we process them ourselves. We will use the participant’s personal data and other personal information only in accordance with applicable data protection laws.

    8. Final Provisions

    (1) Should any provisions of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected.

    (2) German law applies. Legal recourse to review the draw is excluded.
